    Licensing Limbo: Where applications go to die…. Does Glasgow’s STL Licensing System have a Broken Clock? April 10, 2025 Posted by: STL, Glasgow Office Category: Uncategorized No Comments Something is not working well within the Glasgow Short-Term Let Licensing System at present.    After an informal (but stark) policy U-turn around planning concerns, the city has successfully issued a significant number of Short-Term Let Licences to various operators. Whilst many newly licensed operators will have had to engage (however successfully) with the planning system in order to obtain licences, many ‘existing operators’ (those making licensing applications prior to the original 01.10.23 deadline) have (after great effort and expense in some cases) seen their licences issued.   However, for a growing number of those who have applied more recently, the system appears to be increasingly broken and, as a result, unnecessarily speculative. STL Solutions is aware of a number of STL applicants who, despite making and paying for competent STL Licence applications in the city, appear unable to actually obtain thoselicences that they have applied for.    This is not because the authority is refusing these applications but because (having accepted them) it is simply refusing to make any determination at all.  Keep in mind that, under most expected circumstances, unless and until a licence is granted, an STL licence applicant cannot operate their property as an STL. Would-be self-caterers have therefore become trapped in a kind of licensing limbo.  The law does provide a solution (set out below), but unless the authority engages, acknowledges failings and issues confirmations, this could be of little practical assistance to those applicants involved.   Where a licence application is not determined within statutory deadlines, that application is deemed granted for one year.  (Civic Government (Scotland) Act 1982, Section 3(4), “Discharge of functions of licensing authorities”.)  The timescale for determination of a Short-Term Licence application is 9 months from the date of application, subject to various further conventions. (ibid, Section 3(1)) The fact that applicants might pay for an application at a fee scale that expects a 3-year licence to be issued whilst seeing only a 1-year deemed licence arrive (requiring earlier renewal, greater administrative burden and less ‘value for money’ in terms of the fee charged) is disappointing, as is the fact that any licensing authority
